We are all paying tax for years and the way USCIS works...we would get the GC only by next birth. This is very ridiculous rule.

I'm in the same boat. My original RIR is denied because of screw up by the company and lawyer (they admit it). They are exploring the option of converting from TR to RIR.

It should be from the date of approval, but USCIS seem to optimizing the process to make it valid from previous EAD expiry date
see page 2 in the following link
http://www.dhs.gov/xlibrary/assets/CISOmbudsman_RR_25_EAD_USCIS_Response-06-20-06.pdf
relevant text is reproduced here
Second, the Ombudsman recommended that USCIS issue Employment Authorization
Documents valid as of the date any previoua EAD expires.
USCIS processes a large number of applications for EAbs through a highly productive automated batch processing system, which has significantly decreased EAD processing times and allowed for resources to be devoted to other adjudication tasks, thereby resulting in improved customer service. At present, the validity period on these batch processed EADs begins on the date that the application is approved, not the date that a previous EAD expired.
Abandoning automated batch processing would require USCIS to divert immense resources fromm adjustment applications to the adjudication of interim benefits (i.e., EAD applicati~ns). Although some customers would benefit fiom receiving an EAD that is valid fiom the date their current EAD expires rather than the date their EAD applications are approved, the overall result would be quite negative since it would divert adjudicative resources to interim benefit processing.
Not only would USCIS and its customers be iil-served by such a change in the process, but such a change would run contrary to the Ombudsman's recommendation that USCIS davate more resources to upiiont processing of adjustment applications and less to the processing of interim benefits. USCIS does agree with the Ombudsman that when a customer files a timely renewal application for an EAD, it would be preferable to synchronize the validity dates of new and expiring EADs. USCIS believes that improved productivity through technology and automation is the future of immigration benefit adjudication, and that the batch process is an important step in that direction.
Accordingly, USCIS is assessing the possibilities of integrating synchronization of EAD validity dates into the present batch system. USCIS will keep the Ombudsman apprised of any significant
progress on this front.

Hi John, I don't consider myself a pro but I'll be more than happy to offer an opinion. I have the exact same set up as you - D70, SB600 speedlight, ect... The best way to get useable rodeo shots with our set up is to shoot rodeos held during daylight. I didn't mean that to sound like a smart ass remark, it's just you have three things working against you during night rodeo photography, the lack of light, the distance and freezing the action. I shot a rodeo that started out with daylight and went into the night. During the daylight hours I was using a 70-300mm zoom with a 2X extender, as it got darker I took the extender off and found a spot closer to the action. I also put my ISO at 1600 and put my SB600 on. If I remember right I was probably around 1/60 or 1/80 and was using the flash to stop the action and to my knowledge there isn't anyway of getting around the animal-flash-eye's syndrome. I just used photoshop to fix it during the post processing. But needless to say the ratio of useable photos during the night portion of the rodeo went way down. Even though I moved as close as possible (right up against the fence 90% from where the bulls were coming out) I had new problems to contend with, for one the dust kicked into the air would work against the flash and wash out the shot. So in that instance you have to rely on luck and timing. So I'd say move around and find your best vantage point and if you have photoshop learn how to use the "curves" function (clicking the white eyedropper on whats supposed to be white in your photo and black on whats supposed to be black). Probably not the solution you were looking for but a few ideas. The bigger fix would to get a camera that has 3200 ISO capabilities. I know there are a few Canon rodeo shooters here that can inform you about that here. Below are a couple links to a couple of my night shots. Good luck.

"Immigration. Despite intense pressure from social conservatives and conservative GOP populists, Bush stood firm against immigration restrictions that cut off economic opportunities for all newcomers. "We hear claims that immigrants are somehow bad for the economy, even though this economy could not function without them," he told lawmakers, some of whom are pushing immigration law changes that Bush opposes.
Such talk is music to the ears of businesses that rely on immigrant labor. But the President will have to hang tough to avoid tough immigration restrictions sought by his party's right wing. "

"President Bush understands that continued American economic leadership is not a birthright. We must do everything we can to keep our workforce competitive. This includes a commitment to better math and science education, new worker training programs and improved access to highly educated foreign workers," said Sandra Boyd, National Association of Manufacturers Human Resources Policy Vice President and Compete America Chair.

I just applied for my little one yesterday.
fingers crossed!
Can't believe getting usa passport for my little one required two page application and just the birthcert, But for PIO they need everything in the world!
PIO is GREEN CARD for India.
How many papers you have sent for your PERM & I-140 so far?
You need to hire a truck to send your I-485 papers in next stage.

Does she have EAD? If not on H1, she needs to be in EAD. (or other status like F1 etc). Otherwise she is out of status. In that case, H1 will be denied because an H1 application while out of status will lead to denial.
She is not out of status. A person who filed I485 can not be out of status. Her status is "adjustee - AOS pending". Thanx.

Well, as a matter of fact "employer is employer" - there is nothing called good or bad. Any employer can be bad during crunch times. Times have changed now and there is more scrutiny over consulting companies these days because they have lot of immigrants on payroll. Look for urself, your family, ur need etcc.. before changing jobs, be it consulting or fulltime. Sometimes FT jobs can be worse as you never know what kinda shit u may get into.

She is one of the pro-immigration leader and deserves a Thank You. Updated her Wiki profile with the below:
'Congresswoman Zoe Lofgren has shown exemplary leadership and conviction when she made USCIS honor the decision of July 2007 Visa Bulletin and again accepting employment-based I-485 (Adjustment of Status) filings. USCIS had earlier reversed their decision and had stopped accepting the application for adjustment of status. With Zoe's timely involvement and pressure from pro-immigration skilled professionals, USCIS re-started acceping the applications and thus avoided a costly litigation against them.'
Please feel free to edit/append. :)

Hi Googler,
Please read 485 standard operating procedure along with uscismanual. uscis manual is the latest update/modify. If anyone know updates after september 2006, please post on this thread. Thanks -
Clockwork,
The SOP --i.e. the step by step procedure given here in your 485 Stand Proc file (http://immigrationvoice.org/forum/attachment.php?attachmentid=138&d=1184798238) is badly outdated -- for example there is no mention of these horrifying name checks, how they are initiated, how they follow up(what is described there is the old version of background checks, none of that applies any more; the service center information is outdated etc etc.)
I think your "uscismanual" file is captured in the current CIS AFM (see link in Andy Garcia's post above) but it is not a step by step SOP, again there is no mention of security checks etc. As far as I know there is no publicly available version of the current SOP.
I wanted to point this out in case people go away thinking the world is still operating as described in that badly outdated file.

Filing the application to port as seperate after the 140 is approved assures the attorney & the employer of of 2 things:
1. The attorney gets more money for filing a seperate application.
2. The employer gets to keep you tied down longer since its likely that the USCIS wont know what to do when a seperate application is filed just to port the date. Its not a documented procedure (that I am aware of) in that you have to file Form I-xxx or whatever.
Best to port the PD at the time of filing the 140.
Disclaimer: I am EB3 and I havent tried porting my date to EB2. Just using my basic common sense.

please change the subject of this thread to "loan denied" otherwise its assumed to be H1/Stamping denied
I'm not sure about Mortgage.
But for Cars I heard below.
One of my known Uncle who is having GC went to buy Lexus car in NJ and they hesitated to approve him loan and by this my Uncle got upset and he downpaid whole money. Ofcourse he is Wealthy.
One of my collegue who is in US from past 3.5 years went to Honda showroom and they didn't approve him Loan as he doens't have valid Visa & I-797 is valid for couple of months only.
Forget about Banks, even Credit Unions are doing the same.

Thank you very much for the replies.
Right now I am leaning towards cancelling my trip, even though it is going to cost me the entire price of the ticket, besides of course the immeasurable cost of not visiting home.
About the suggestion of hiring a lawyer, can an immigration lawyer here in the US help me in any way with a situation (the renewal interview) and an all-powerful person (the interviewer) half-way across the world? I can see how a lawyer may help smooth this problem if I were changing status while in the country (say from F1 to H1), but I don't see how a lawyer would help with my visa renewal...perhaps I just don't understand the extent to which a lawyer may be able to help. Is my question clear?
Again, thank you for the advice.
The lawyer will be able to tell you (i) what is the legal implication of your charge in regard to F-1, (ii) statute of limitations of your charges, (iii) how long the records are kept (there are levels of access and with time some charges go down the levels). A lawyer gives you legal counsel (suggestions/appraisals); they are not supposed to "do" stuff for you, nor take decisions for you. You pay your lawyer simply for reliable information (and paperworks, usually).
